Fault, Arizona Law, & the Cyclist’s Right to Recover
Arizona treats cyclists as full participants in traffic. Under ARS 28-812, a person riding a bicycle on a roadway has the same rights and is subject to the same duties as the driver of a motor vehicle. ARS 28-815 requires a cyclist traveling slower than surrounding traffic to ride as close as practicable to the right-hand curb or edge, with recognized exceptions for passing, left turns, avoiding hazards, and lanes too narrow to share safely.
Drivers who pass cyclists must leave a safe distance of no less than three feet under ARS 28-735. A violation that causes serious injury or death carries a civil penalty, and it can also serve as evidence of negligence in a personal injury claim.
Arizona follows a pure comparative negligence rule under ARS 12-2505. An injured cyclist can still recover damages even if found partially at fault. The damages award is reduced by the cyclist’s percentage of fault, but no threshold bars recovery entirely. Insurers know this rule and often argue that a cyclist bears a larger share of fault to reduce what they pay. Preparing a case with litigation in mind is one of the most effective ways to push back on those arguments.

Bicycle Accident Attorney in Phoenix
Trial-Ready Representation for Injured Phoenix Cyclists
Klink Law represents injured cyclists throughout Phoenix and the surrounding Arizona communities. Attorney David J. Klink leads the firm and handles personal injury claims directly, including those arising from bicycle accidents caused by another party’s negligence. Clients work with our firm from the initial investigation through insurance negotiations and, when needed, litigation preparation rather than being passed between staff members or case managers.
Bicycle accident claims carry a specific risk that other personal injury claims don’t always share. Under Arizona’s pure comparative negligence standard, insurers have a financial incentive to argue that an injured cyclist bears more fault than they actually do. Every percentage point shifted onto the cyclist reduces the insurer’s payout. We prepare every case with court in mind so we’re in a position to challenge those fault arguments, whether at the negotiating table or before a judge.
If you were injured in a Phoenix bicycle accident, contact our firm today for a free consultation. Attorney David J. Klink can review your claim personally. Call (602) 483-6059 to get started.
