Negligent Security Where Your Recovery Is Our Mission

Negligent Security Lawyer in Glendale, AZ

Attorney David J. Klink Handles Your Case Directly. No Case Managers, No Handoffs.

When a property owner fails to take reasonable steps to protect lawful visitors from foreseeable criminal harm, the law may hold that owner accountable. Negligent security is a form of premises liability: the victim isn’t suing the person who attacked them, but the property owner whose failure to act made the attack possible. Klink Law represents individuals in Glendale who have been assaulted, robbed, or otherwise harmed because a property owner cut corners on security.

Attorney David J. Klink leads the firm and handles each case directly. Clients work with the attorney responsible for their claim from the first call through resolution. No rotating staff, no intermediaries.

If you were harmed on someone else’s property in Glendale, AZ, contact Klink Law to discuss your potential claim at no cost. Call (602) 483-6059 to schedule a free consultation.

Elements of a Negligent Security Claim Under Arizona Law

Arizona premises liability law generally requires property owners to exercise reasonable care in maintaining safe conditions for lawful visitors, including taking steps to prevent foreseeable criminal harm. To pursue a negligent security claim, an injured person must establish four elements.

Duty of Care
The property owner owed the injured person a duty to provide reasonably safe conditions. This duty applies to lawful visitors, tenants, guests, and customers. A person who was trespassing at the time of the injury generally can’t bring a negligent security claim.

Breach of Duty
The owner breached that duty by failing to implement adequate security measures given the foreseeable risk of criminal harm on the property.

Causation
The security failure caused the injury. The harm must be connected to the breach, not merely coincidental to it.

Damages
The injury produced actual, compensable losses. Damages in a negligent security claim may include medical expenses, lost wages, pain and suffering, and other economic and non-economic losses.

How Insurance Companies Respond to These Claims in Glendale

Property owners’ insurers handling negligent security claims may attempt to reduce or deny liability. Common tactics include arguing the crime wasn’t foreseeable, that the victim contributed to the incident, or that assault-related coverage is excluded under the policy. Insurers may also contact victims shortly after an incident to obtain recorded statements, and providing a statement without legal representation can harm the value of a claim.

Arizona follows a pure comparative negligence rule under A.R.S. § 12-2505. An injured person may still recover compensation even if they were partly at fault, but the awarded amount is reduced by their percentage of fault. Insurers understand this rule well and may use it in negotiations. We manage those communications on behalf of our clients and prepare every case for litigation from the outset, so if an insurer refuses to offer fair compensation, we’re ready to pursue the claim in Maricopa County court.
